Terms of Service

1. Acceptance

By accessing or using ArtMakers (“the Platform”), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Platform. The Platform is operated by Christopher De Oliveira Eberhard, c/o Impressumservice Dein-Impressum, Stettiner Straße 41, 35410 Hungen, Germany (“we”, “us”).

2. Alpha access

ArtMakers is currently in closed Alpha. Access is granted on an invitation-only basis. We reserve the right to revoke access, modify features, or shut down the Platform at any time without notice. Alpha software may contain bugs and is provided without any uptime guarantees.

3. Account & eligibility

You must be at least 18 years old to use the Platform. You authenticate via X (Twitter) and are responsible for keeping your credentials secure. You may only create one account per person. We reserve the right to suspend or terminate accounts that violate these terms.

4. User content

You retain full ownership of the artworks and content you upload (“User Content”). By uploading content, you grant us a non-exclusive, worldwide, royalty-free licence to display and store your User Content solely for the purpose of operating the Platform. You are solely responsible for ensuring that your User Content does not infringe third-party rights or violate applicable law.

5. Prohibited conduct

You agree not to:

• Upload content you do not own or have rights to
• Harass, impersonate, or harm other users
• Scrape, reverse-engineer, or abuse the Platform
• Upload illegal content or malware
• Attempt to gain unauthorised access to any part of the Platform

6. Intellectual property

All Platform code, design, branding, and non-user content is owned by us and may not be copied, reproduced, or distributed without prior written consent.

7. Disclaimer & limitation of liability

The Platform is provided “as is” without warranties of any kind. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Platform. Our total liability shall not exceed €100.

8. Termination

You may delete your account at any time by contacting legal@artmakers.app. We may terminate or suspend your access at any time for violation of these terms.

9. Governing law

These terms are governed by German law. The exclusive place of jurisdiction is Berlin, Germany.

10. Changes

We may update these terms at any time. Continued use of the Platform after changes constitutes acceptance of the updated terms.
